BOOKING TERMS & CONDITIONS

Effective Date: July 29, 2026

These Booking Terms & Conditions govern all trips booked with Zealous Travel Company LLC, a Colorado limited liability company (“Zealous,” “we,” “us,” or “our”).

Please read these Terms carefully before booking. By submitting a booking, paying a deposit or other amount, or electronically accepting these Terms, you acknowledge that you have read, understood, and agreed to be bound by them.

These Terms are separate from any Participant Waiver & Release of Liability required for participation in a Zealous trip.

1. BOOKING YOUR TRIP

1.1 Booking Request and Acceptance

Submitting a booking request or payment does not by itself guarantee a place on a trip or guarantee that the trip will operate.

A booking is accepted once Zealous confirms the reservation by email. Participation may also be subject to completion of required forms, acceptance of the Participant Waiver & Release of Liability, payment of all amounts due, and satisfaction of applicable trip requirements.

Guests must provide complete and accurate information when booking. The name provided must match the guest’s passport or other required travel identification.

1.2 Deposits

The deposit amount varies by trip and will be displayed during checkout or otherwise communicated before booking.

Unless otherwise stated for a particular trip or promotion, deposits are fully refundable within seven calendar days of the original booking date. This seven-day refund period does not apply to bookings made fewer than 45 calendar days before departure.

After the applicable seven-day refund period, deposits are non-refundable except where expressly stated in these Terms or required by applicable law.

A promotion or special booking offer may contain different deposit or refund terms. When clearly disclosed before purchase, those specific terms will control.

1.3 Final Payment

Unless otherwise stated in writing, the remaining trip balance is due 45 calendar days before departure.

Bookings made fewer than 45 calendar days before departure require payment in full at the time of booking.

If payment is not received by the applicable deadline, Zealous may treat the reservation as canceled by the guest. The cancellation terms in Section 3 will apply, and Zealous may retain any amounts permitted under those terms.

1.4 Minimum Participation and Guaranteed Departures

Some departures require a minimum number of participants to operate.

A trip is guaranteed only after Zealous sends written confirmation by email that the departure is guaranteed. Website availability, acceptance of a deposit, payment of a balance, or other communications do not constitute a guarantee unless the email expressly states that the departure is guaranteed.

Zealous may cancel a departure that does not meet its minimum participation requirements, subject to Section 3.6.

1.5 Airfare and Independent Travel Arrangements

Guests should not purchase non-refundable or non-changeable airfare or make other non-refundable travel arrangements until Zealous confirms by email that the trip is guaranteed.

A guest who purchases airfare or makes other arrangements before receiving that confirmation does so at their own risk. Zealous is not responsible for airfare, lodging, transportation, visa fees, insurance premiums, or other expenses incurred because a trip has not yet been guaranteed, except as required by applicable law.

Even after a trip is guaranteed, guests are strongly encouraged to purchase flexible travel arrangements and comprehensive travel insurance.

1.6 Pricing Errors

Zealous makes reasonable efforts to ensure that trip descriptions and prices are accurate. Nevertheless, typographical, technical, administrative, or system errors may occasionally occur.

Zealous reserves the right to correct such errors, including after a booking request has been submitted or a payment has been made.

If a material pricing error affects a reservation, Zealous will notify the guest as soon as reasonably possible. The guest may either proceed with the reservation at the corrected price or cancel the affected reservation and receive a full refund of the amounts paid to Zealous for that reservation.

This provision applies to genuine errors and does not permit Zealous to increase a confirmed price merely because demand has increased.

1.7 Price Adjustments

Trip prices are based in part on costs and exchange rates available when the trip is priced.

Zealous reserves the right to make a reasonable post-booking price adjustment when a significant and unforeseen change in foreign currency exchange rates, government taxes, mandatory fees, permit charges, or fuel surcharges materially increases the cost of operating the trip.

Zealous will provide reasonable notice and an explanation of any material adjustment. Price adjustments will not be made solely because demand increased or Zealous later determined that a trip could have been priced more profitably.

2. WHAT IS INCLUDED

The services included in the trip price are those expressly identified as included in the applicable trip description, itinerary, booking page, or written confirmation.

Unless expressly identified as included, the trip price does not include items such as:

  • International or domestic airfare;

  • Passport or visa expenses;

  • Travel insurance;

  • Medical treatment, rescue, or evacuation;

  • Baggage fees;

  • Meals, beverages, or gratuities not specifically listed as included;

  • Personal purchases or incidental expenses;

  • Optional activities;

  • Additional transportation or accommodations caused by delays, early departures, illness, missed connections, or personal choice; or

  • Any other service not expressly identified as included.

Trip descriptions and itineraries should be read together with these Terms.

3. CANCELLATIONS, CHANGES, AND TRANSFERS

3.1 Cancellation by a Guest

Cancellation requests must be submitted to Zealous in writing at trips@zealoustravelco.com.

A cancellation becomes effective on the calendar date Zealous receives the written request.

Unless different terms were clearly disclosed for a specific trip or promotion, the following cancellation schedule applies:

*The seven-day refund period does not apply to a booking made fewer than 45 calendar days before departure.

A refund will never exceed the amount the guest has actually paid to Zealous.

The applicable cancellation terms are based on the scheduled departure date and the date Zealous receives the written cancellation request.

3.2 Non-Refundable Deposit

Where the table states that a refund is calculated less the deposit, the applicable deposit remains non-refundable.

For example, a refund equal to 75% of the total trip price, less the deposit, means that the deposit is first excluded from the refundable amount and the stated refund percentage is then applied as described in the cancellation schedule.

Zealous may revise this calculation language with legal counsel to ensure that the intended cancellation charges are expressed as clearly as possible.

3.3 Outstanding Amounts

The cancellation schedule applies to the total trip price, not merely to installments already paid.

If the applicable cancellation charge exceeds the amount already paid, the guest remains responsible for the outstanding amount, to the extent permitted by applicable law.

3.4 Missed or Unused Services

No refund or credit is provided for:

  • Late arrival;

  • Early departure;

  • Missed activities;

  • Meals or services a guest chooses not to use;

  • Removal from an activity or trip under these Terms;

  • Inability to participate because of insufficient fitness, illness, injury, missing documentation, or personal circumstances; or

  • Any other unused portion of the trip resulting from a guest’s action, choice, or circumstances.

3.5 Trip Transfers

A guest may request one transfer of their booking to another Zealous departure, subject to all of the following:

  • The request must be submitted in writing at least 60 calendar days before the original departure;

  • The transfer is subject to availability and Zealous’s written approval;

  • A $100 administrative fee applies;

  • The guest must pay any increase in the price of the replacement trip;

  • Any treatment of a lower-priced replacement trip will be determined by Zealous and communicated before the transfer is finalized;

  • The transfer may not be transferred again; and

  • The replacement departure may be subject to its own booking deadlines, eligibility requirements, and supplier restrictions.

A transfer is not effective until confirmed by Zealous in writing.

Requests received fewer than 60 calendar days before departure are governed by the normal cancellation policy unless Zealous expressly agrees otherwise in writing.

3.6 Cancellation by Zealous

Zealous may cancel a trip before departure because of insufficient participation, supplier unavailability, safety concerns, operational impracticability, or other circumstances that prevent Zealous from reasonably operating the trip.

If Zealous cancels a trip for reasons other than force majeure, guest misconduct, failure to pay, failure to satisfy participation requirements, or another breach by the guest, Zealous will generally offer one or more of the following:

  • A transfer to another available departure;

  • A future trip credit; or

  • A refund of amounts paid to Zealous for the canceled trip.

The remedy offered may depend on the circumstances and any amounts recoverable from suppliers.

Zealous is not responsible for airfare, insurance premiums, visa expenses, equipment purchases, pre-trip or post-trip lodging, or other independent expenses arising from a cancellation. Guests should use flexible bookings and appropriate travel insurance.

3.7 Force Majeure

“Force majeure” means an event or circumstance beyond Zealous’s reasonable control that prevents, materially affects, or makes it unsafe or impracticable to operate a trip as planned.

Force majeure events may include, without limitation:

  • Severe weather;

  • Wildfire, flood, earthquake, avalanche, rockfall, or other natural disaster;

  • Epidemic, pandemic, quarantine, or public health emergency;

  • War, terrorism, civil unrest, or political instability;

  • Government orders, border closures, travel restrictions, or permit restrictions;

  • Labor disputes or strikes;

  • Transportation shutdowns;

  • Infrastructure failure;

  • Supplier failure caused by circumstances beyond Zealous’s reasonable control; or

  • Similar extraordinary events.

If a trip cannot operate or must be materially changed because of force majeure, Zealous will determine an appropriate remedy based on the circumstances, supplier policies, costs already incurred, and amounts recoverable by Zealous.

A remedy may include rescheduling, a future travel credit, an alternative itinerary, or a refund to the extent funds are recoverable from suppliers. Zealous does not guarantee a cash refund for amounts that have already been paid or committed to non-refundable suppliers.

3.8 Discretionary Accommodations

Zealous may, at its sole discretion, offer a partial refund, trip credit, transfer, or other accommodation in an exceptional situation.

Any such accommodation is voluntary, applies only to the particular circumstances in which it is offered, does not establish a precedent, and does not amend these Terms.

4. TRAVEL INSURANCE

Comprehensive travel insurance is required for every guest.

The policy must be valid for all applicable travel dates and destinations and must include coverage for:

  • Emergency medical treatment;

  • Emergency evacuation;

  • Repatriation;

  • Trip cancellation; and

  • Trip interruption.

Guests should consider additional coverage for travel delays, baggage loss or delay, missed connections, adventure activities, pre-existing medical conditions, supplier failure, and any other risks relevant to their trip.

It is the guest’s responsibility to confirm directly with the insurer that the policy covers all planned destinations, elevations, activities, and circumstances. Some standard policies exclude trekking above certain elevations, off-piste skiing, via ferrata, canyoning, rafting, horseback riding, or other adventure activities.

Zealous does not sell, underwrite, interpret, or guarantee insurance coverage. Any insurance claim is governed solely by the guest’s policy and insurer.

Guests must provide proof of required insurance upon request. Zealous may deny participation to a guest who does not obtain or provide proof of adequate coverage. No refund will be due when participation is denied because a guest failed to obtain required insurance.

All medical, rescue, evacuation, repatriation, transportation, and related expenses are the guest’s responsibility, whether paid personally or through insurance.

5. TRAVEL DOCUMENTS AND ENTRY REQUIREMENTS

Guests are solely responsible for obtaining and carrying all documents required for their travel, including:

  • A valid passport;

  • Visas or travel authorizations;

  • Vaccination or health documentation;

  • Permits;

  • Airline documentation;

  • Parental or guardianship documentation, when applicable; and

  • Any other documentation required by a government, airline, supplier, or destination.

Passport, visa, health, and entry requirements may change. Guests should independently verify current requirements with the appropriate government agencies and travel providers.

Zealous is not responsible when a guest is denied boarding, entry, participation, or continued travel because of missing, expired, inaccurate, damaged, or otherwise insufficient documentation.

No refund or credit will be provided for services missed because a guest did not satisfy applicable documentation or entry requirements.

6. FITNESS, HEALTH, AND ACTIVITY REQUIREMENTS

Adventure travel can be physically and mentally demanding. Guests are responsible for choosing a trip that is appropriate for their health, fitness, abilities, experience, and comfort level.

Before booking, each guest should carefully review the applicable:

  • Itinerary;

  • Activity rating;

  • Daily mileage;

  • Elevation gain and loss;

  • Altitude;

  • Terrain;

  • Weather and climate;

  • Accommodations;

  • Transportation;

  • Required equipment; and

  • Other trip-specific information.

By booking, the guest represents that they have reviewed the trip information and reasonably believe they are physically and medically capable of participating safely.

6.1 Health and Medical Information

Guests must notify Zealous in writing before departure of any medical condition, injury, disability, allergy, dietary restriction, pregnancy, medication requirement, or other circumstance that could materially affect:

  • Their ability to participate;

  • Their need for assistance;

  • The safety of the guest or another person; or

  • Zealous’s or a supplier’s ability to deliver the trip safely.

Zealous may request additional information when reasonably necessary to evaluate trip suitability or make appropriate arrangements.

Providing medical information does not guarantee that Zealous or its suppliers can accommodate every condition or need. Zealous may determine that a trip or activity is not appropriate for a guest when participation would create an unreasonable health, safety, or operational risk.

6.2 Medical Advice

Zealous does not provide medical advice. Guests are responsible for consulting an appropriate healthcare professional regarding their fitness to travel and participate.

6.3 Medications and Medical Equipment

Guests are responsible for bringing:

  • An adequate supply of all prescription and non-prescription medications;

  • A reasonable additional supply in case of delays;

  • Any required medical devices or equipment; and

  • Appropriate storage, documentation, and backup supplies.

Zealous, its trip leaders, guides, and suppliers generally cannot obtain prescription refills, store medications, or administer medications.

6.4 Guide Authority and Participation Decisions

For the safety and well-being of the guest and group, Zealous trip leaders, local guides, and activity providers may modify, restrict, suspend, or end a guest’s participation in an activity when they reasonably believe continued participation would create a health or safety risk.

Such decisions may take into account the guest’s fitness, experience, preparation, conduct, equipment, medical condition, pace, weather, terrain, guide instructions, or other relevant circumstances.

No refund will be provided for an activity or service missed because of a reasonable safety or participation decision.

6.5 Inability to Continue

If a guest is unable or chooses not to complete an activity or continue the trip because of health, fitness, injury, illness, insufficient preparation, fear, personal choice, or another personal circumstance, the guest is responsible for all resulting costs.

These costs may include additional transportation, lodging, meals, medical treatment, rescue, evacuation, replacement guides, or other arrangements.

7. COMMUNITY EXPECTATIONS AND GUEST CONDUCT

Zealous is committed to creating a safe, welcoming, respectful, and enjoyable experience.

Guests must treat fellow travelers, trip leaders, guides, local partners, residents, staff, and the places visited with courtesy and respect.

Guests agree to:

  • Follow reasonable instructions from Zealous trip leaders, local guides, drivers, and activity providers;

  • Arrive on time for scheduled departures and activities;

  • Respect local laws, customs, cultures, communities, and environments;

  • Follow Leave No Trace principles where appropriate;

  • Use alcohol responsibly;

  • Refrain from possessing or using illegal drugs;

  • Avoid conduct that creates unnecessary danger; and

  • Avoid materially disrupting the experience of the group.

Harassment, discrimination, threats, intimidation, violence, unwanted sexual conduct, and other abusive behavior are prohibited.

7.1 Removal from an Activity or Trip

Zealous may remove a guest from an activity or dismiss a guest from a trip, without refund, when the guest:

  • Endangers themselves or another person;

  • Violates applicable law;

  • Harasses, threatens, discriminates against, or abuses another person;

  • Repeatedly refuses to follow reasonable safety or logistical instructions;

  • Uses alcohol or other substances in a manner that creates a safety or behavioral concern;

  • Materially disrupts the safety, operation, or enjoyment of the trip; or

  • Otherwise materially violates these Terms.

When reasonably possible, Zealous may first attempt to address the conduct directly. Immediate removal may nevertheless occur when warranted by safety, legal, or operational concerns.

A dismissed guest is responsible for all resulting transportation, accommodation, meals, rebooking, and other costs. Zealous has no obligation to provide further trip services after dismissal.

8. ITINERARY FLEXIBILITY AND TRIP CHANGES

Adventure travel is inherently dynamic. Flexibility is an essential part of the experience.

Zealous will make reasonable efforts to operate each trip substantially as described. Nevertheless, itineraries, routes, accommodations, transportation, activities, guides, meals, and schedules may change before or during a trip.

Changes may be made because of:

  • Weather or environmental conditions;

  • Wildfire or smoke;

  • Trail, road, border, or facility closures;

  • Flooding, avalanche danger, rockfall, or other hazards;

  • Transportation delays or cancellations;

  • Government action or political unrest;

  • Permit or regulatory restrictions;

  • Public health concerns;

  • Supplier cancellations or failures;

  • Illness or injury;

  • Group condition or ability;

  • Guide judgment; or

  • Other safety, operational, or unforeseen circumstances.

Zealous, its trip leaders, local guides, and activity providers have authority to modify the itinerary when they reasonably determine that a change is appropriate for safety, practicality, or the overall operation of the trip.

8.1 Substitutions

Zealous may substitute accommodations, transportation, routes, guides, activities, meals, or other services with reasonable alternatives.

Zealous will make reasonable efforts to provide an alternative of comparable purpose or quality, but an identical substitution cannot be guaranteed.

8.2 Refunds for Itinerary Changes

No refund or compensation is guaranteed for an itinerary change, substituted service, missed activity, shortened activity, route change, or other modification caused by circumstances beyond Zealous’s reasonable control.

When Zealous receives a recoverable supplier refund for a material service that was not provided, Zealous may pass some or all of that recovery to affected guests, after accounting for reasonable costs and replacement arrangements. Any such payment will depend on the circumstances and does not create a general entitlement to reimbursement.

8.3 Additional Expenses

Unless caused by Zealous’s failure to provide a service as promised and except where applicable law requires otherwise, guests are responsible for additional expenses caused by:

  • Weather or travel disruptions;

  • Missed or canceled flights;

  • Baggage delays;

  • Passport or visa issues;

  • Illness or injury;

  • Early arrival or departure;

  • Trip interruption;

  • Personal choice; or

  • Other matters outside Zealous’s reasonable control.

9. ACCOMMODATIONS, TRANSPORTATION, AND SUPPLIERS

9.1 Independent Suppliers

Zealous works with hotels, lodges, transportation providers, guides, activity operators, restaurants, equipment providers, and other independent suppliers.

These suppliers generally own, control, manage, and operate their respective services and facilities. They are independent contractors and are not employees of Zealous.

Zealous carefully selects its partners but cannot control every act, omission, decision, schedule change, or operational failure of an independent supplier.

Nothing in this section limits any responsibility that cannot legally be excluded.

9.2 Accommodations and Room Assignments

Accommodations are subject to availability and may be substituted when reasonably necessary.

Room size, layout, amenities, furnishings, views, bed configuration, noise level, and other characteristics vary by property and destination. Specific rooms, beds, roommates, or configurations cannot be guaranteed unless Zealous expressly confirms the arrangement in writing.

9.3 Registered Guests Only

Only registered Zealous guests may stay in or access accommodations arranged as part of the trip unless Zealous expressly authorizes otherwise.

Visitors, friends, family members, or anyone not registered on the trip are not permitted inside guest rooms or accommodations arranged by Zealous unless expressly authorized.

Guests are responsible for any loss, damage, security concern, fee, or other consequence caused by an unauthorized visitor.

9.4 Transportation

Transportation type, vehicle size, seating, timing, and routing may vary depending on group size, destination, road conditions, supplier availability, and operational requirements.

Seat assignments generally cannot be guaranteed.

9.5 Incidental Expenses and Damage

Guests are responsible for personal and incidental expenses, including minibar charges, room service, laundry, damages, optional purchases, and services not included in the trip price.

A guest is responsible for damage they cause to accommodations, vehicles, equipment, or other property, excluding ordinary wear and tear.

10. BORROWED OR RENTED EQUIPMENT

When Zealous lends or provides equipment directly to a guest, the guest must use it responsibly and follow all care and safety instructions.

Unless Zealous provides different written instructions, borrowed equipment must be returned within seven calendar days after the trip or the date requested by Zealous.

Equipment must be returned:

  • Reasonably dry;

  • Free of excessive mud, dirt, sand, or debris;

  • With all components and accessories; and

  • In substantially the same condition in which it was received, excluding ordinary wear and tear.

Guests should not machine wash, chemically treat, repair, or materially alter borrowed equipment unless instructed by Zealous.

Any loss, malfunction, or damage must be reported promptly.

Normal wear and tear is acceptable. A guest may be charged for excessive damage resulting from misuse, neglect, unauthorized washing or repair, failure to follow instructions, or other unreasonable treatment.

Lost, stolen, or unreturned equipment must be reimbursed at its current retail replacement cost.

Equipment supplied by an independent rental provider is also subject to that provider’s terms and charges.

11. OPTIONAL AND INDEPENDENT ACTIVITIES

A guest may choose to participate in activities, transportation, dining, nightlife, excursions, or other services that are not included in the Zealous itinerary.

Unless Zealous expressly identifies the service as included and operated by Zealous, those activities are independent arrangements undertaken at the guest’s own discretion and risk.

The guest is responsible for evaluating the provider, safety, insurance, suitability, timing, and cost of an independent activity.

Zealous is not responsible when an independent activity causes a guest to miss a scheduled departure or included service.

12. PHOTOGRAPHY AND MEDIA

Zealous may take photographs, video, audio, or other recordings during a trip for documentation, community sharing, and marketing.

Guests who prefer not to appear in Zealous marketing materials should notify Zealous in writing before departure.

Zealous will make reasonable efforts to honor an advance opt-out request. Because trips occur in group and public settings, Zealous cannot guarantee that an opted-out guest will never appear incidentally in the background of a photograph or recording.

An incidental appearance does not authorize Zealous to feature or identify an opted-out guest as a primary subject in marketing materials.

Any separate media release or permission obtained from a guest will govern to the extent it provides additional authorization.

13. PRIVACY AND COMMUNICATIONS

Zealous may collect and use personal information reasonably necessary to:

  • Process bookings and payments;

  • Communicate with guests;

  • Arrange accommodations, transportation, meals, activities, and other services;

  • Address dietary, medical, accessibility, or safety needs;

  • Comply with legal or supplier requirements; and

  • Operate and improve its trips.

Zealous may share necessary information with guides, hotels, transportation providers, activity operators, insurers, emergency personnel, and other suppliers involved in delivering the trip.

Zealous will handle personal information in accordance with its applicable privacy policy and legal obligations.

13.1 Email Communications

Email is Zealous’s primary method of communicating important trip information.

Guests are responsible for:

  • Providing an accurate email address;

  • Monitoring that account before and during travel;

  • Reviewing the spam or junk folder;

  • Reading pre-departure materials and updates; and

  • Promptly notifying Zealous of any change in contact information.

A guest’s failure to read an email does not invalidate a notice properly sent to the email address provided at booking.

Guests should also provide an emergency contact and promptly update that information when necessary.

14. BILLING DISPUTES AND CHARGEBACKS

Guests should contact Zealous promptly at trips@zealoustravelco.com regarding any billing concern or disputed charge so that the parties have a reasonable opportunity to investigate and attempt to resolve the matter in good faith.

A chargeback should not be used to avoid these agreed cancellation, refund, transfer, or payment terms.

Zealous reserves the right to contest a chargeback it reasonably believes is inconsistent with these Terms and to provide the payment processor or financial institution with relevant booking records, communications, acceptance records, and other supporting documentation.

Nothing in this section waives any non-waivable right a guest may have under applicable consumer protection or payment-card law.

15. ASSUMPTION OF RISK AND PARTICIPATION DOCUMENTS

Adventure travel involves inherent and other risks, including risks associated with remote environments, physical activity, transportation, weather, terrain, wildlife, altitude, equipment, guides, other participants, and limited access to medical services.

Before participating, each guest may be required to review and electronically sign a separate Participant Waiver & Release of Liability tailored to Zealous activities.

The separate waiver is incorporated into the participation requirements but remains a distinct document from these Booking Terms & Conditions.

A guest who does not sign required participation documents may not participate. A failure or refusal to sign does not entitle the guest to a refund.

16. COMPLAINTS AND CONCERNS

A guest should raise a concern as soon as reasonably possible during the trip so that Zealous, the trip leader, guide, or supplier has an opportunity to address it.

When a concern cannot be resolved during the trip, the guest should submit a written description to trips@zealoustravelco.com promptly after returning.

The notice should include relevant details, dates, supporting materials, and the resolution requested.

Zealous will review the concern in good faith. Failure to provide notice while a problem could reasonably have been addressed may affect Zealous’s ability to investigate or offer a remedy.

17. GENERAL LEGAL TERMS

17.1 Governing Law

These Terms and any dispute arising from or relating to them, a booking, or trip services will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

17.2 Venue

To the extent a dispute is properly resolved in court, the parties consent to the exclusive jurisdiction and venue of the state courts located in Arapahoe County, Colorado, or the applicable federal court serving that county, except where applicable law requires otherwise.

17.3 No Waiver

A failure or delay by Zealous in enforcing any provision does not waive Zealous’s right to enforce that provision later.

A discretionary exception or accommodation made for one guest or circumstance does not require Zealous to provide the same exception in another case.

17.4 Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permissible or modified only to the extent necessary.

The remaining provisions will continue in effect.

17.5 Entire Agreement

These Terms, the applicable booking confirmation, trip-specific disclosures, payment terms, privacy policy, and any separately executed Participant Waiver & Release of Liability constitute the agreement between Zealous and the guest concerning the booking.

They supersede prior oral or written representations concerning the same subject matter.

If a trip-specific written term expressly conflicts with these general Terms, the trip-specific term will control for that booking.

17.6 Amendments

Zealous may update these Terms periodically.

The version accepted at the time of booking generally governs that reservation unless:

  • The guest agrees to an updated version;

  • A change is required by law;

  • A change is necessary to correct an error; or

  • The update does not materially reduce the guest’s contractual rights.

17.7 Assignment

A guest may not assign or transfer a booking, contractual right, or claim without Zealous’s prior written consent, except through an approved trip transfer under Section 3.5 or as required by law.

Zealous may assign its rights and obligations in connection with a merger, sale, reorganization, or transfer of its business, provided the assignment does not materially reduce the guest’s contractual rights.

17.8 Electronic Acceptance

The parties agree to conduct the booking transaction electronically.

Selecting an acceptance checkbox, submitting a booking, making a payment after receiving these Terms, or providing another legally recognized electronic acceptance constitutes the guest’s signature and agreement to be bound.

Zealous may retain electronic records showing the version accepted, date and time of acceptance, payment information, and other relevant transaction details.

17.9 Headings

Section headings are provided for convenience and do not alter the meaning of these Terms.

17.10 Survival

Any provision that by its nature should remain effective after cancellation, dismissal, completion of the trip, or termination of the booking relationship will survive, including payment obligations, equipment responsibilities, dispute provisions, and applicable limitations or releases.

ACKNOWLEDGMENT

By submitting a booking, making a payment, or electronically accepting these Terms, the guest acknowledges that they:

  • Have read and understood these Booking Terms & Conditions;

  • Agree to be legally bound by them;

  • Understand the applicable payment and cancellation terms;

  • Understand that comprehensive travel insurance is required;

  • Have reviewed the physical and logistical demands of the selected trip; and

  • Understand that a separate Participant Waiver & Release of Liability may be required before participation.
